Assault

Assault charges are typically filed as simple or aggravated assault. To be convicted of simple assault, the prosecutor must prove that the assault occurred in one of the following manners:
  • Intentional, knowing, or reckless attempt to cause bodily harm
  • Negligently caused bodily harm using a deadly weapon
  • Intimidation of imminent bodily harm through the use of physical menace
  • Penetration of a law enforcement or jail official with a hypodermic needle during arrest or search
Simple assault is typically charged as a second-degree misdemeanor, which can lead to up to two years in jail. However, the crime may also be charged as a third- or first-degree misdemeanor, depending on the circumstances. For a first-degree misdemeanor charge of assault, five years behind bars may be the outcome.

 Aggravated assault charges deal with more serious instances of violence, such as:

  • Serious bodily injury caused by an extreme indifference to life
  • Threat of serious bodily injury to a first responder, such as a police officer or firefighter
  • Causing or attempting to cause serious bodily injury to a teacher while the teacher is working

As a felony of the second or first degree, aggravated assault can lead to up to 20 years in prison. In most cases, it is charged as a second-degree felony, unless the victim is a police officer or a firefighter. Homicide

In most cases, homicide charges revolve around the defendant’s intent. Premeditated, willful homicide is first-degree murder. Second-degree murder charges involve the commission of a dangerous felony. Known as felony murder, this charge does not require an intent to kill. Third-degree murder, on the other hand, does require the state to prove that the defendant had an intention to murder. This category of murder is a sort of catch-all for all other types of murder not considered first- or second-degree murder. 

Homicide charges require the strongest defense. Penalties for a conviction can result in life without parole or death for first-degree murder. Second-degree murder can also lead to life in prison without parole, and third-degree murder carries up to 40 years behind bars. 

The penalties for manslaughter charges are not as severe as those for murder charges. However, a voluntary manslaughter charge can result in 20 years incarcerated, and a conviction of involuntary manslaughter up to 10.
